Six Key Points to Understand About Nautical Insurance

1 - Types of Third-Party Liability

There are basically two types of Liability Insurance contracts in marine insurance:

  • Compulsory liability insurance – this only covers damage to third parties, up to the limit established by law (Royal Decree 607/1999 of 16 April).

  • Voluntary liability insurance – this covers damage to your own vessel. An excess (deductible), payable by the policyholder, may be applied under the voluntary insurance.

2 - Skipper Qualifications

In order to be covered in the event of a claim, the skipper operating the vessel must hold the appropriate licence (PNB, PER, etc.), have successfully passed all inspections required by the competent authority, and carry on board the necessary documentation for navigation.

3 - Navigation Radius & Geographic Coverage

The coverage radius is agreed per policy. It’s also essential that all vessel documentation, including maintenance records, is up to date.

4 -Policies for 7th and 6th Register Vessels

The navigation radius covered by each policy is agreed individually. It is also essential that all vessel documentation, such as inspections and revisions, is kept fully up to date.

Most national insurers in Spain only provide cover for 7th List registered vessels, which are used exclusively for private and recreational purposes (whether motor-powered or sailing).

If you own a speedboat, catamaran, sailing yacht or motorboat and use it for professional purposes—such as commercial fishing, sporting activities, charters, rentals with skipper, or house-boat rentals under 6th List registration—there are specialised insurance companies offering tailored products. 5 - How to Calculate the Insured Value of Your Boat

It is common practice to assign one value to the hull and keel, and another to the engine (or, in the case of sailing boats, to the sails, which must be declared individually).

These values should normally reflect the replacement cost as new of each item. When taking out the policy, it is essential to include all fittings and accessories that are not permanently fixed to the hull (unless you expressly do not wish to insure them). Otherwise, in the event of a claim, the insurer will not cover any damage affecting those items.

6 - English Clauses vs Spanish Clauses in Boat Insurance Policies

“Spanish Clauses” vs “English Clauses”

In marine insurance contracts, there are two types of conditions depending on which clauses are applied: the so-called “Spanish Clauses” and the “English Clauses.” Although their origin differs from current practice, nowadays policies drafted in Spain are generally considered to fall under the Spanish clauses.

The English clauses, however—originally drafted by the Institute Yacht Clauses in London—generally offer a broader scope of cover (with some exceptions). The key difference in practice is that under English clauses, you can agree on a specific insured value for the vessel. Spanish clauses, on the other hand, base compensation on the vessel’s market value (venal value).

Whenever possible, it is preferable to take out insurance under English clauses.

At C1 Broker, we offer you the possibility of contracting either Spanish Clauses or English Clauses (Institute Yacht Clauses) for all vessels with an insured value above €20,000.

Typical risks covered include: shipwreck, jettison (the act of throwing cargo or other heavy items overboard to lighten the vessel in a storm), grounding, stranding, collision with fixed or floating objects, storms, sinking (excluding cases due to poor maintenance), theft in secure and locked premises, and malicious acts by third parties.

Notable exclusions include: damage to sails torn by wind, detachment of outboard engines, defective maintenance of the vessel, purely mechanical failures of any kind, gross negligence, or damage occurring when leaving the vessel anchored unattended in beaches or coves without assistance.

In the event of total loss caused by an insured risk, compensation is usually paid at the vessel’s market value, less the residual value of the wreck, which always remains the property of the insured. If an accident occurs abroad, the insured may contact a certified claims adjuster (Comisario de Averías—a surveyor specialised in transport and marine insurance), who will handle the assessment and forward the valuation to the insurance company.

Documentation and Infringements

According to Law 27/1992 of 24 November, on State Ports and the Merchant Navy, it is mandatory to keep on board proof of payment of the insurance premium for the current period. This serves as evidence of valid cover, provided it includes at least the following details:

  • The insurance company providing the cover.

  • Sufficient identification of the insured vessel.

  • The coverage period, with the exact start and end date and time.

  • A statement that it refers to compulsory liability insurance.

This documentation must always be kept on board the vessel. If requested by the competent authorities and the document is not available at the time, the policyholder has five working days to prove that the insurance is valid.

The operation of leisure vessels without proper insurance, as established by law, constitutes a serious infringement under Chapter III, Title IV of Law 27/1992 on State Ports and the Merchant Navy.
